The High Court in Accra has discharged Mildred Donkor, the third accused person in the ongoing GHS49 million theft case involving former National Signals Bureau Director-General Kwabena Adu-Boahene and his wife, Angela Adjei-Boateng.
Her discharge follows a formal notice filed by the Attorney General and Minister for Justice, Dr. Dominic Ayine, seeking to discontinue prosecution against her under Section 59 of the Criminal and Other Offences (Procedure) Act, 1960 (Act 30).
The decision, filed on Wednesday, October 15, 2025, comes after Ms. Donkor reportedly agreed to testify as a prosecution witness in the ongoing case.
Her testimony is expected to provide further insight into the alleged theft and misappropriation of state funds linked to Adu-Boahene (1st accused), Adjei-Boateng (2nd accused), and their company, Advantage Solutions Limited (4th accused).
Delivering his ruling, Justice John Nyadu Nyante dismissed an objection raised by Atta Akyea, counsel for the first accused, who argued that the Attorney General should have filed a motion rather than a notice of withdrawal.
Mr. Akyea contended that the prosecution’s amendments were too significant to be effected by a simple notice to the court.
However, the judge overruled the objection, emphasizing that the Attorney General, as the constitutionally mandated authority to prosecute criminal cases, does not require the court’s consent to exercise discretion in discontinuing a case.
“The Attorney General’s authority to withdraw prosecution is grounded in the Constitution and may be exercised at any stage of the proceedings,” Justice Nyante stated.
Following the ruling, Ms. Donkor was officially discharged, with the court directing that all records relating to her be expunged from the case.
Ms. Donkor’s role in the case had drawn attention after she dismissed her lawyer in open court on July 18, moments before the prosecution was set to call its first witness. Her subsequent cooperation with the prosecution marks a significant turn in the high-profile case involving the alleged embezzlement of public funds.
